Ce d\u00e9bat a mis en \u00e9vidence, comme son titre l\u2019indique, la situation actuelle des droits humains au Maroc. Madame Khadija Ryadi a \u00e9galement mis l\u2019accent sur le retour, depuis quelques ann\u00e9es, sur les acquis de la fin des ann\u00e9es quatre-vingt-dix. Cet \u00e9v\u00e9nement a r\u00e9uni, dans la salle Louise Michel, une quarantaine de personnes venant de diff\u00e9rentes villes d\u2019Ile-de-France afin d\u2019\u00e9changer avec Madame Ryadi et rencontrer les amis de l\u2019AMDH \u00e0 Paris.<\/p>\n<p><strong>Principaux points abord\u00e9s<\/strong><\/p>\n<p><span style=\"text-decoration: underline;\">Mot d\u2019introduction<\/span><\/p>\n<p><a href=\"http:\/\/amdhparis.org\/wordpress\/wp-content\/uploads\/2010\/12\/Photo-1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-13\" title=\"Photo 1\" src=\"http:\/\/amdhparis.org\/wordpress\/wp-content\/uploads\/2010\/12\/Photo-1-300x225.jpg\" alt=\"\" width=\"300\" height=\"225\" srcset=\"http:\/\/amdhparis.org\/wordpress\/wp-content\/uploads\/2010\/12\/Photo-1-300x225.jpg 300w, http:\/\/amdhparis.org\/wordpress\/wp-content\/uploads\/2010\/12\/Photo-1.jpg 720w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a>Mme Khadija Ryadi a commenc\u00e9 par rappeler que l\u2019AMDH a comme r\u00e9f\u00e9rentiel les conventions internationales et que les progr\u00e8s qu\u2019a connu le Maroc ces derni\u00e8res ann\u00e9es ne l\u2019emp\u00eache pas de continuer sa lutte jusqu\u2019\u00e0 la cons\u00e9cration des droits humains reconnus \u00e0 l\u2019\u00e9chelle internationale.<\/p>\n<p>Madame Khadija Ryadi en a profit\u00e9 pour rappeler les longues luttes et les \u00a0sacrifices qui ont \u00e9t\u00e9 faits au Maroc comme en France.<\/p>\n<p><span style=\"text-decoration: underline;\">Quelques rappels historiques\u00a0: <\/span><\/p>\n<p>Lors de la guerre froide, les droits de l\u2019homme \u00e9taient mis en avant par les Etats unis d\u2019Am\u00e9rique contre l\u2019URSS. Dans ce cadre international, un d\u00e9but d\u2019ouverture politique est entam\u00e9 au Maroc. Elle a d\u00e9but\u00e9 lors des ann\u00e9es 1990 jusqu\u2019\u00e0 la fin du r\u00e8gne d\u2019Hassan II. Premi\u00e8rement avec la ratification de plusieurs pactes internationaux, tel que ceux relatifs aux droits de la femme.<\/p>\n<p>A ce moment l\u00e0, l\u2019Etat marocain, au lieu de continuer \u00e0 combattre le discours sur les droits humains, il adopte une strat\u00e9gie d\u2019<strong>appropriation de ce discours<\/strong>. Les violations faites dans le pass\u00e9 son ressortis.<\/p>\n<p>Sur le plan institutionnel, on a mentionn\u00e9 les droits de l\u2019Homme dans le pr\u00e9ambule de la constitution, chose qui n\u2019existait pas avant\u00a0<em>: \u00ab\u00a0le Royaume du Maroc souscrit aux principes, droits et obligations d\u00e9coulant des chartes desdits organismes et r\u00e9affirme son attachement aux droits de l&rsquo;homme tels qu&rsquo;ils sont universellement reconnus.\u00a0\u00bb.<\/em><\/p>\n<p><span style=\"text-decoration: underline;\">Les acquis r\u00e9alis\u00e9s ont \u00e9t\u00e9 partiels et r\u00e9versibles\u00a0: <\/span><\/p>\n<p>Les acquis dont on parle ne touchent que les <strong>droits civils et politiques (partiels)<\/strong> mais Les violations des droits \u00e9conomiques sociaux et culturels continuent et s\u2019aggravent.<\/p>\n<p>En ce qui concerne les acquis sociaux et culturels, l\u2019application des diktats du Plan d\u2019Ajustement Structurel, impos\u00e9 par le Fond Mon\u00e9taire International et la Banque mondiale a eu pour cons\u00e9quence le d\u00e9mant\u00e8lement\u00a0 des services sociaux \u00e9l\u00e9mentaires tel que la sant\u00e9 et l\u2019\u00e9ducation.<\/p>\n<p>Quand on parle de <strong>r\u00e9versibilit\u00e9<\/strong> des acquis, on pense aussi aux garantis constitutionnelles toujours inexistantes. La constitution marocaine, n\u2019est pas celle d\u2019un Etat de droit et elle ne permet pas encore de garantir les droits fondamentaux et le statut de citoyens marocains encore consid\u00e9r\u00e9s comme sujets.<\/p>\n<p><span style=\"text-decoration: underline;\">L\u2019\u00e9valuation de l\u2019Instance Equit\u00e9 et R\u00e9conciliation (IER)<\/span><\/p>\n<p>En \u00e9voquant la question de l\u2019instance \u00e9quit\u00e9 et r\u00e9conciliation, Madame Khadija Ryadi a rappel\u00e9 la position de l\u2019AMDH consistant \u00e0 d\u00e9noncer l\u2019impunit\u00e9 des responsables des violations des droits humains, ainsi que le fait que l\u2019association a \u00e9tablit une liste de responsables du nom de \u00ab\u00a0liste des 45\u00a0\u00bb.<\/p>\n<p>En ce qui concerne les recommandations de l\u2019IER, on pense que celles-ci peuvent constituer une avanc\u00e9e majeure si elles \u00e9taient appliqu\u00e9es mais plusieurs d\u2019entre elles restent encore lettre morte sauf pour l\u2019indemnisation des victimes. Mais les plus importantes ne sont pas appliqu\u00e9es tel que l\u2019adh\u00e9sion du Maroc au statut de Rome relatif \u00e0 la Cour P\u00e9nale Internationale, l\u2019harmonisation des lois nationales, l\u2019\u00e9laboration d\u2019une strat\u00e9gie de lutte contre l\u2019impunit\u00e9, la ratification des conventions et protocoles non encore ratifi\u00e9es, etc.<\/p>\n<p><strong>Le retour sur les acquis\u00a0:<\/strong><\/p>\n<p><span style=\"text-decoration: underline;\">Violence et Torture<\/span><\/p>\n<p>Madame Khadija Ryadi a insist\u00e9 sur le fait que l\u2019usage injustifi\u00e9 de la violence et les cas de torture sont loin d\u2019\u00eatre d\u00e9pass\u00e9 mais, bien au contraire, sont tr\u00e8s r\u00e9currents de nos jours. On pense aux cas innombrables li\u00e9s \u00e0 ce qu\u2019on appelle \u00ab\u00a0lutte contre le terrorisme\u00a0\u00bb. Madame Ryadi a \u00e9galement affirm\u00e9 que l\u2019AMDH consid\u00e9rait que la majorit\u00e9 des d\u00e9tenus sont innocents, et que beaucoup de ces arrestations ont \u00e9t\u00e9 faites de mani\u00e8re arbitraire.<\/p>\n<p>En \u00e9voquant le th\u00e8me de \u00ab\u00a0la lutte contre le terrorisme\u00a0\u00bb on pense \u00e0 des cas marquants comme celui de l\u2019affaire Bellirej (5 personnes \u00e9tant toujours incarc\u00e9r\u00e9es) ou encore, le cas du groupe Tamek qui a connu \u00e0 plusieurs reprises des violences et tortures de la part de l\u2019Etat.<\/p>\n<p><span style=\"text-decoration: underline;\">Libert\u00e9 d\u2019expression<\/span><\/p>\n<p>On assiste de nos jours \u00e0 une floraison d\u2019une presse jeune qui est victime d\u2019une grande r\u00e9pression de la part de l\u2019Etat marocain.<\/p>\n<p>On note le cas du journaliste et d\u00e9fenseur des droits humains Chakib Alkhayari qui est entrain de purger une peine de trois ans de prison pour avoir d\u00e9nonc\u00e9 le commerce de drogue dans la r\u00e9gion de Nador (marchica).<\/p>\n<p>Madame Khadija Ryadi a not\u00e9 que le principe des sacralit\u00e9s qui sert \u00e0 placer des lignes rouges \u00e0 la libert\u00e9 d\u2019expression, est vide se sens et que celui-ci connait un usage clairement politique. Elle a \u00e9voqu\u00e9, dans ce cadre, le cas des huit membres de l\u2019association arr\u00eat\u00e9 pour avoir scand\u00e9 des slogans mettant en exergue la responsabilit\u00e9 du Roi dans d\u00e9t\u00e9rioration de la situation socio\u00e9conomique du Maroc.<\/p>\n<p><span style=\"text-decoration: underline;\">Condition de la femme <\/span><\/p>\n<p>Une r\u00e9forme du code de la famille a \u00e9t\u00e9 faite, ce qui constitue sans doute une avanc\u00e9e. La r\u00e9forme, en revanche, n\u2019est pas all\u00e9e vers le sens de la cons\u00e9cration de l\u2019\u00e9galit\u00e9 entre l\u2019homme et la femme. Les principales r\u00e9serves \u00e9tant les suivantes\u00a0:<\/p>\n<ul>\n<li>L\u2019in\u00e9galit\u00e9 en mati\u00e8re d\u2019h\u00e9ritage<\/li>\n<li>Interdiction du mariage mixte pour les femmes (une femme de confession musulmane ne peut pas \u00e9pouser un non musulman\u00a0!)<\/li>\n<li>L\u2019\u00e2ge du mariage pour les filles.<\/li>\n<\/ul>\n<p><span style=\"text-decoration: underline;\">R\u00e9pression contre les \u00e9tudiants<\/span><\/p>\n<p>La r\u00e9pression dont sont victimes les\u00a0 \u00e9tudiants persiste encore. L\u2019un des cas les plus marquants, \u00e9tant celui du groupe de Zahra Boudkour, qui ont \u00e9t\u00e9 arr\u00eat\u00e9s et emprisonn\u00e9s suite \u00e0 une action syndicale protestataire.<\/p>\n<p><span style=\"text-decoration: underline;\">Cas d\u2019expropriation <\/span><\/p>\n<p>Une violation des droits \u00e9conomiques et sociaux des femmes a \u00e9t\u00e9 faite, dans le cas des terres collectives\u00a0pour lesquelles les hommes ont \u00e9t\u00e9 les seuls \u00e0 \u00eatre indemnis\u00e9s.<\/p>\n<p><strong>La constitution\u00a0: <\/strong><\/p>\n<p>C\u2019est un point primordial pour l\u2019AMDH. La constitution actuelle ne consacre ni la d\u00e9mocratie ni les droits de l\u2019Homme car ne garantissant pas la s\u00e9paration des pouvoirs, les concentrant tous entre les mains du chef d\u2019Etat. Le fait que l\u2019Etat et la religion soient m\u00eal\u00e9s constitue \u00e9galement une entrave \u00e0 l\u2019av\u00e8nement de la d\u00e9mocratie.<\/p>\n<p>Il est \u00e0 noter que la constitution actuelle, ne donne pas de libert\u00e9 aux r\u00e9gions et ne mentionne pas l\u2019identit\u00e9 et la langue Amazighe, points qui selon l\u2019AMDH devrait \u00eatre revus.<\/p>\n<p>L\u2019AMDH, ne propose pas de projet de constitution, mais demande \u00e0 ce que la constitution marocaine soit harmonis\u00e9e avec les conventions internationales.<\/p>\n<p><strong>Le Sahara : <\/strong><\/p>\n<p>Pour la question du Sahara, l\u2019AMDH ne prend pas de position politique non plus, mais appelle \u00e0 une cessation des violations des droits humains faites par toutes les parties du conflit. Madame Khadija Ryadi a appel\u00e9 \u00e0 la mise en place d\u2019un instrument ONUSIEN pour le suivi de la situation des violations des droits humains dans la r\u00e9gion que ce soit au Sahara ou \u00e0 Tindouf.<\/p>\n<p>La position de l\u2019AMDH est de recommander une solution d\u00e9mocratique du conflit dans le Sahara qui soit accept\u00e9e par les parties en conflit et qui puisse \u00e9viter une guerre dans la r\u00e9gion.<\/p>\n<p>Madame Khadija Ryadi a estim\u00e9 que l\u2019Etat marocain est entrain de jouer avec le feu en remontant des populations contre d\u2019autres dans le cadre de ce conflit.<\/p>\n<p><strong>Mot de conclusion<\/strong><\/p>\n<p>La pr\u00e9sidente de l\u2019AMDH a conclu son intervention, en soulignant le fait que le Maroc donne, de lui-m\u00eame, une image inexacte et que celui-ci est beaucoup moins respectueux des droits humains que l\u2019on pourrait le croire.<\/p>\n<p><strong>Les principaux points ressortis lors du d\u00e9bat\u00a0: <\/strong><\/p>\n<ul>\n<li>Intervention d\u2019Amin Alkhayari fr\u00e8re de Chakib Alkhayari<\/li>\n<li>La responsabilit\u00e9 europ\u00e9enne dans le non respect des pactes internationaux.<\/li>\n<li>La collaboration de l\u2019AMDH avec les autres associations de d\u00e9fense des droits de l\u2019Homme au niveau international.<\/li>\n<li>La situation des candidats \u00e0 l\u2019\u00e9migration au Maroc<\/li>\n<li>La situation des femmes marocaines en France (cas d\u2019Aicha Chikaoui, dont le p\u00e8re meurt, en partie, \u00e0 cause de ses conditions de travail en France, et qui tout en \u00e9tant dans un \u00e9tat de sant\u00e9 critique re\u00e7oit une obligation de quitter le territoire fran\u00e7ais)<\/li>\n<li>La privatisation de la sant\u00e9 qui constitue un retour sur les droits \u00e9conomiques et sociaux<\/li>\n<li>Le Code du travail ne reconnaissant pas le travail domestique<\/li>\n<li>R\u00e9pression de l\u2019homosexualit\u00e9 (\u00e0 T\u00e9touan deux pr\u00e9sum\u00e9s homosexuels ont subis un test de d\u00e9pistage VIH)<\/li>\n<\/ul>\n<p><strong><em>Extraits vid\u00e9o :<\/em><\/strong><\/p>\n<div id=\"_mcePaste\"
